I just got asked by someone to buy one of my designs to put on t-shirts/clothing. it's a design I've already finished,and the character and image belong to me, they just want the rights to use the image.
How do I handle something like this? Can I just give them the rights to it for their use, and keep the right to use it again myself, or do I sell it away exclusively to them?
I'm not sure what the norm is, but I was thinking I should ask for a straight fee and then maybe 5% royalties. Does that sound fair? Or should I just go without asking for royalties? They are a small company just starting up, so I don't think I'm looking at a lot of money either way. How much should I ask for? I like the character and I'd like to be able to use him in the future, but it's not terribly important to me. I'm so confused!!
If anyone has experience with this kind of thing, please give me any information you're willing to. I'm grateful for any help I get.

Question #1: You own all rights to your work, and can sell as many of them as you are willing to and/or a client is wiling to buy. Of course , as the creator, it's always in your best interest to maintain as much control over your work as possible.
Question #2: In general, you're better off getting as much up front vs. royalties as possible, since royalties almost never exceed an advance, and have to be kept track of, collected, etc. Royalties are like the lottery, occasionally you hit it big, but most of the time you don't see anything. It's nice to have them in the contract, just in case, but don't let the promise of royalties make you settle for less than you think the work is worth.

Take the $$ upfront most likely they wont sell shit and its just another character, drwa another one and find a bigger company to share royalties with. You cant be to precious with your work, you should design it, sell it and move on!
But if it's something more complex such as a comic or book, think about your future and look at the royalties. If it's just one character, take the money and move on.
